Grand Jury Refuses To Indict Nick Diaz in domestic violence case – Prosecution Still Moves Ahead

Nick Diaz is all out of luck.

In Clark County the DA’s office decided to go ahead with charges against Nick Diaz in spite of the fact that a grand jury refused to indict him.

“They couldn’t convince 12 jurors, and now they’re basically disregarding what the jury said,” attorney Ross Goodman told Las Vegas Review-Journal. “We’re telling those grand jurors, ‘We don’t really care what you decide.’”

As a reminder Diaz was arrested back in May after allegedly injuring a paramour. This lead to his arrest and initial charges for domestic battery. UFC froze his contract and will not take any action until the legal process is complete, stressing its code of conduct while also citing the right to due process.

“The organization does not tolerate domestic violence and requires all athletes to adhere to the UFC Fighter Conduct Policy. Every athlete is deserving of due process and this situation, as with any official allegations, will be duly reviewed and thoroughly investigated by an independent party.”

Deputy District Attorney Bryan Schwartz said he had just submitted the woman’s voluntary statement to the court.

“Mr. Goodman has also been in touch with me about some evidence about the victim days after the incident that could potentially help our office evaluate the case better,” he said. “If he wants to maybe discuss a dismissal, I’d love to see some of the evidence he has.”

Chelini rescheduled the preliminary hearing for Aug. 30.

“This thing’s going to be done one way or another in 30 days,” she said.
