Melqui Galvão’s legal team has filed a motion requesting his transfer from a special prison in São Paulo’s northern zone to house arrest, citing a recent shoulder surgery.
The request was submitted last Monday, with a court ruling expected in the coming days.
Galvão, who also works as an investigator with the Amazonas police, is currently in pre-trial detention on accusations of sexually abusing a 17-year-old athlete during a championship in Italy in February.
Additional accusers came forward following that initial report.
The defense’s case for house arrest centers on a shoulder procedure Galvão underwent three weeks ago at a São Paulo hospital.
His lawyers submitted a medical report claiming he needs at least 30 physiotherapy sessions, five to seven days per week, and argued the prison cannot adequately provide that care.
Several developments complicate that argument. Just two weeks before the request was filed, a raid on Galvão’s cell found a cell phone hidden in his underwear.
Prison management has also told the court that the required physical therapy can be administered on-site.
The most significant issue came from the attorney representing the athlete who reported the abuse.
That lawyer submitted documents showing the clinic proposed for Galvão’s treatment shares an address with Galvão Saúde e Performance, a company in Jundiaí co-owned by Galvão and his wife.
Court records also include photos suggesting a close personal relationship between the proposed physiotherapist and Galvão’s family.
Adding to the scrutiny, São Paulo’s Public Prosecutor’s Office initially agreed to the house arrest proposal, a position that now stands in sharp contrast to the mounting evidence of potential conflicts of interest as the court prepares to rule.
